Bringing a Fatal Accident Claim
Fatal accidents not only cause terrible emotional suffering but also very often, financial hardship as well. That is where we, as fatal accident specialists, can assist.
There are two parts to a fatal accident claim. The first is an award for any pain, suffering, and loss of amenity that the deceased person experienced. If they died immediately, or did not regain consciousness, then little or no compensation will be awarded for this element of the fatal accident claim. This part of the fatal accident claim also includes financial losses from the date of the injury causing the fatality to the date of death and includes funeral expenses.
The second part of the fatal accident claim allows claims to be brought by the dependants of the deceased for the loss of financial support. Dependants, under a fatal accident claim, are specifically defined as the surviving spouse or a co-habitee of the opposite sex who has lived with the deceased for more than 2 years. They also include children, parents, persons treated as children or parents, grandchildren, and grandparents. Compensation under this part of the fatal accident claim is awarded for the loss of support since the death and consists of that portion of the deceased's contribution to the family earnings which they would not have spent exclusively on themselves, plus any services that they provided such as childcare, domestic assistance, gardening, or DIY. In addition, under a fatal accident claim, there is a statutory sum for bereavement of £10,000.00 which is payable to the spouse of the deceased or to the parents of a deceased minor.
